1. Why this privacy policy?
Each person who uses the website (hereinafter referred to as the “User”) discloses a certain amount of personal data. This personal data is information which allows us to identify you as a natural person, regardless of whether we actually do this. You are identifiable as soon as it is possible to create a direct or indirect link between one or more data and you as a natural person.

We only use and process your personal data in conformity with the relevant Privacy Act. Every reference to the ‘Privacy Act’ in this Privacy Policy is a reference to the Regulation of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).

Via this Privacy Policy, every User of the Website is informed of the processing activities that CIBO may carry out with its personal data. CIBO reserves the right to modify this Privacy Policy at any time. Every substantial change shall be clearly communicated to the User. We recommend that the User should regularly consult this document.
2. Who shall process the personal data?
2.1. Controller
CIBO is responsible for the processing and decides alone or in cooperation with others which personal data is collected and for what purpose, as well as the technical and organisational means used for processing this personal data.
2.2. Processor(s)
CIBO is free to avail of the services of data processors. A processor is a natural person or legal entity who/that processes personal data on the request of or on behalf of the controller. The processor shall be bound to ensure the security and confidentiality of the data. The processor shall always comply with the instructions of the controller.

3. What are the legal grounds on which my data will be processed?
In accordance with the Privacy Act and the Regulations, we process personal data based on the following legal grounds:

Based on the consent granted by the User for processing his/her personal data;
Based on the fulfilment of the agreement as agreed with the User, or the implementation of pre-contractual steps taken on his/her application; or
Based on compliance with the provisions of law or regulations, relating to the management of the contractual relationship;
Based on the legitimate interest of CIBO to help the User with the questions that are asked on the basis of the contact form or for sending electronic communications.
4. Which personal data is processed?
CIBO undertakes to only collect and process personal data that is relevant to the objective and is required for the purposes for which it is processed. The following categories of personal data are processed:

  • Personal identification data (first name, surname, address, company);
  • Contact details (telephone number and email address);
  • Electronic identification data (IP address, location, cookies). 
This information can be collected if you use the contact form on the Website. Other personal data may be collected at a later point in time, e.g. in connection with our after-sales. The amount of data collected depends on your use of the Website and the functionalities thereof.

Other data that may be requested at a later stage is primarily business data. If we request further personal data here, this may relate to the following personal data:

  • Financial data (bank account, etc.)
In addition, we use cookies to recognise the User and to provide a personal user experience, in order to remember their technical choices and to detect and rectify errors on the Website, if any. Please refer to our Cookie Policy for more information concerning the manner in which we use cookies.
5. For what purposes are my personal data being used?
CIBO collects your personal data in order to offer every User of the Website a safe, optimal, and personal user experience. CIBO reserves the right to suspend or cancel specific operations if data is missing, incorrect, or incomplete.

Data processing is essential for the operation of the platform and the services relating thereto. Processing shall be exclusively done for the following specific purposes:

  • Customer management: customer administration, order management, deliveries, invoicing, support, and complaints monitoring;
  • Protection against fraud and infringements;
  • The response to questions, as well as remarks that are obtained through the contact form.
  • The offer and improvement of the personalised and general services by the controller, provision of information, newsletters, and offers that are useful to and/or required by the user, and the provision of support, and in connection with digital marketing.
  • The offer and improvement of the services provided.
  • Statistical purposes.
During a visit to the Website, certain data is collected for statistical purposes. Such data is necessary to optimise the use of our Website. This data includes the IP address, presumed place of consultation, time and date of consultation, which pages were visited. When you visit the Website, you automatically declare your consent to such data collection for the statistical purposes as described above.

The User himself/herself always provides the personal data to CIBO and in this manner can exercise a certain control. If certain data is incomplete or manifestly incorrect, CIBO reserves the right to temporarily or permanently suspend certain expected actions.
6. Who receives your personal data?
Your personal data will exclusively be processed for internal use within CIBO. Your personal data shall not be sold, forwarded, or communicated to third parties, except where you have given us your explicit consent for the same in advance or because another legal or other obligation is imposed on CIBO to forward the data, such as in connection with legal procedures.
7. How long do we retain your personal data?
Your data will be retained for as long as this is necessary to achieve the objectives laid down in Clause 5. 

Your data shall be removed from the database when they are no longer required for these purposes or if the User validly exercises the right to delete the personal data. If the User wishes to have more information about the retention of his/her personal data, he/she may exercise his/her right to access, as provided for in Clause 8.2. 

8. What are your rights?
8.1 Guarantee of a lawful and secure processing of the personal data
Your data will be retained for as long as this is necessary to achieve the objectives laid down in Clause 5. 

Your data shall be removed from the database when they are no longer required for these purposes or if the User validly exercises the right to delete the personal data. If the User wishes to have more information about the retention of his/her personal data, he/she may exercise his/her right to access, as provided for in Clause 8.2. 

8.2 Right of access
Your personal data may always be processed for legitimate purposes, as laid down in Clause 5. 

They will be collected and processed in an appropriate, relevant, and proportional manner, and will not be retained for longer than is necessary to achieve the objectives laid down.

8.3 Right to rectification of personal data
Inaccurate or incomplete information may be rectified. Requests for change may be sent to us.
8.4 Right to erasure of your personal data (‘right to be forgotten’)
You shall also have the right to delete your personal data in the following cases:

  • Your personal data is no longer required for the intended purpose;
  • You have revoked your consent to the processing of your data and there is no other legal basis for processing your data;
  • You have legally submitted an objection to the processing of your personal data;
  • Your data is illegally processed;
  • Your data must be deleted to comply with a legal obligation.
The deletion of data is primarily related to visibility; it is possible that the deleted data is still temporarily stored.
8.5 Right to restriction of processing
In some cases, you shall have the right to request the restriction of the processing of your personal data. This certainly applies in the event of a dispute concerning the accuracy of data, if the data is necessary in the context of legal proceedings, or for the time required by CIBO to verify that you can validly exercise your right to erasure.
8.6 Right to object
You have the right at all times to object to the processing of your personal data for ‘direct marketing’ purposes, profiling purposes, or purposes arising from the legitimate interests of the controller. CIBO shall refrain from processing your personal data unless it can demonstrate that there are compelling legal grounds for the processing of your personal data that prevail over your right to object to the same.
8.7 Right to data portability
You have the right to obtain any personal data that you have provided to CIBO in a structured, commonly used, and machine-readable format. You also have the right to transfer this personal data to another controller, unless this is technically impossible.
8.8 Right to revoke your consent
You have the right to revoke your consent at any time, for example when you have given the same for direct marketing purposes.
9. How can you exercise your rights?
If you wish to exercise your rights, you must send a written request and proof of identity by registered mail to CIBO, Deugenietstraat 5, 3150 Tildonk or via email to [email protected]. We shall respond as soon as possible, and no later than one (1) month after receipt of the request.
10. Possibility of lodging a complaint
If you do not agree with the processing of your personal data by CIBO, you will have the right to lodge a complaint with the competent supervisory authority (for Belgium: https://www.gegevensbeschermingsautoriteit.be).
